1. Introduction
Welcome to bongsmm. By accessing or using our Social Media Marketing (SMM) panel, you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Service.
These Terms form a binding agreement between you (“User”, “you”) and bongsmm (“Company”, “we”, “us”).
2. Definitions
- Service: The bongsmm SMM panel, tools, and related features.
- Order: A request you submit for a service (e.g., followers, likes, views).
- Balance/Credit: Prepaid funds in your bongsmm account.
- Platform: Social networks where services are delivered (e.g., Facebook, YouTube).
- API: Programmatic interface that allows automated ordering (if enabled).
3. Eligibility
- You must be at least 18 years old or the age of majority in your jurisdiction.
- You represent that any information you provide is accurate and complete.
4. Account Registration & Security
- You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
- Enable strong passwords and, where available, two-factor authentication.
- Notify us immediately of unauthorized access or security breaches.
- We may suspend accounts suspected of fraud, abuse, or policy violation.
5. Services Description
We provide automated SMM services (e.g., followers, likes, views, comments) for supported Platforms. We are not affiliated with, endorsed by, or partnered with any Platform.
- Delivery speed, quality, and retention can vary.
- Platform updates, rate-limits, or anti-spam rules may affect results.
- We do not guarantee specific outcomes such as monetization or verification.
- Ensure your links are correct and accessible (public visibility).
- Avoid placing overlapping/duplicate orders for the same link simultaneously.
6. Acceptable Use & Prohibited Conduct
You agree NOT to use the Service to:
- Violate any laws or third-party rights, or encourage illegal activity.
- Target content that is hateful, violent, sexualized involving minors, promotes self-harm, or incites harm.
- Spam, phish, scrape data, or attempt to circumvent Platform or Service security.
- Interfere with Service operation (e.g., DDoS, abuse, reverse engineering, automated scraping).
- Submit misleading links, shortened URLs masking destinations, or private/protected content.
7. Orders, Accuracy & Delivery
- Order Finality: Orders are processed automatically; once started, changes or cancellations may not be possible.
- Accuracy: You must provide a correct link and required parameters; errors can lead to failed or partial delivery.
- Delivery Window: ETAs are estimates only and may vary due to Platform rate-limits, maintenance, or demand.
- Completion Mark: If an order is marked “Completed” and you disagree, contact support within 48 hours.
- Partial Delivery: We may deliver partially and adjust at our discretion (replacement/partial refund per policy).
8. Pricing, Payments & Balance
- Pricing: Prices may change without prior notice. Current rates appear in the panel or API.
- Payments: You authorize charges through available methods. Fees from processors are your responsibility.
- Balance: Funds added are treated as prepaid credit and are generally non-withdrawable.
- Taxes: You are responsible for any taxes applicable in your jurisdiction.
- Chargebacks: Unauthorized disputes may result in suspension; resolve billing issues via support first.
9. Refunds, Replacements & Cancellations
- No-Refund Policy: All sales are final. Refunds are only considered for proven Service-side technical failures.
- Replacements: At our discretion, we may re-run or replace affected portions if retention drops or Platform changes occur.
- Cancellations: If an order has not started, we may attempt to cancel; otherwise, cancellation may be unavailable.
- Overpayments: Credited to your account balance.
Submitting duplicate or conflicting orders voids eligibility for refunds/replacements.
10. API Terms (if applicable)
- API keys are confidential; you are responsible for all requests made with your key.
- We may rate-limit, throttle, or revoke API access for abuse or instability risks.
- Do not expose API credentials in client-side code or public repositories.
- Follow documented request/response formats; malformed usage may be blocked.
11. Privacy & Data Protection
- We collect only data necessary to operate the Service (account, orders, logs).
- We do not sell your personal data. We may share with processors strictly for Service delivery or as required by law.
- You may request access, correction, or deletion of your data, subject to legal/operational limits.
- Use of cookies or similar technologies may be required for authentication and analytics.

12. Security, KYC/Verification
- We implement reasonable technical and organizational measures; no system is 100% secure.
- We may require identity or payment verification (KYC) to prevent fraud or comply with legal obligations.
- Suspicious activity may trigger temporary holds, reviews, or suspension.
13. Availability, Maintenance & SLA
- Availability: We aim for high availability but do not guarantee uninterrupted Service.
- Maintenance: Planned maintenance or emergency fixes may occur without advance notice.
- SLA: Any uptime or performance statements are targets, not guarantees, unless a separate written SLA exists.
14. Intellectual Property
- The Service, branding, UI, and content are owned by bongsmm and protected by applicable IP laws.
- You may not copy, distribute, modify, or create derivative works without permission.
15. Third-Party Platforms & Risk
- We are not affiliated with any Platform. Use is at your own risk regarding account bans, content removals, or demonetization.
- Platform algorithm changes may impact delivery, retention, and quality.
16. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including without limitation merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of Liability
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data.
- Our total liability for any claim is limited to the amount you paid to us for the Service in the 30 days preceding the claim.
18. Indemnification
You agree to indemnify and hold bongsmm harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, your breach of these Terms, or violation of third-party rights.
19. Suspension & Termination
- We may suspend or terminate your account with or without notice for violations, fraud, chargebacks, or operational risk.
- Upon termination, your access ceases and any remaining balance may be forfeited at our discretion.
20. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the Kingdom of Cambodia (unless another jurisdiction is specified in a separate written agreement).
- Disputes should first be attempted to resolve amicably via our support channel within 30 days.
- If unresolved, disputes shall be submitted to the competent courts located in Phnom Penh, Cambodia.
21. Changes to the Terms
- We may update these Terms at any time. The “Last Updated” date will reflect changes.
- Continued use after updates constitutes acceptance of the revised Terms.
22. Miscellaneous
- Force Majeure: We are not liable for delays/failures due to events beyond reasonable control (e.g., outages, natural disasters).
- Assignment: You may not assign these Terms without our consent. We may assign in connection with merger, acquisition, or sale.
- Severability: If any provision is invalid, the remaining provisions remain in effect.
- Entire Agreement: These Terms constitute the entire agreement regarding the Service.
- Notices: We may notify you via the panel, email, or your account contact details.
- Language: English version controls in case of inconsistencies.
